Terms of Service

1. Acceptance of Terms
Welcome to FanCraft Market ("Platform", "we", "us", or "our"). By accessing or using our platform, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Platform.
FanCraft Market is a marketplace connecting independent creators ("Vendors") with buyers seeking custom fan-made products and commissions. We facilitate transactions but are not a party to agreements between Vendors and buyers.
2. User Accounts
2.1 Registration
To access certain features, you must register for an account. You agree to provide accurate, current, and complete information and to update it as necessary.
2.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized access.
2.3 Vendor Accounts
Vendor accounts require invitation and admin approval. By creating a Vendor account, you represent that:
- You are at least 18 years old or have parental consent
- You have the legal right to sell the products/services you offer
- You will comply with all applicable laws and regulations
- Your products do not infringe on third-party intellectual property rights
3. Platform Services
3.1 Marketplace Facilitation
FanCraft Market provides a platform for Vendors to list products/services and for buyers to discover and commission custom work through Requests for Quote (RFQs).
3.2 RFQ Deposits
All RFQs require a refundable deposit ($10 by default). This deposit:
- Is fully credited toward your purchase when you accept a Vendor's offer
- May be forfeited if your RFQ remains open with unanswered offers for 30+ days
- Helps ensure serious buyers and reduces spam
3.3 Featured RFQs
Buyers may pay an additional fee ($5) to feature their RFQ for priority visibility to Vendors for 7 days. Featured fees are non-refundable.
3.4 Payment Processing
All payments are processed through Stripe. We hold funds in escrow until order delivery is confirmed. By using our Platform, you agree to Stripe's terms of service.
4. Vendor Obligations
4.1 Product Listings
Vendors must provide accurate descriptions, images, and pricing. Misleading listings may result in account suspension.
4.2 Commission Structure
FanCraft Market charges a commission on completed transactions:
- Launch Period: 0% until February 15th, 2026
- Early Bird rate: 10% of transaction value
- Standard rate: 12% of transaction value
- Commission is automatically deducted from payouts
- Payment processing fees (Stripe) are split 50/50 between vendor and platform

4.3 Order Fulfillment
Vendors must fulfill orders according to the timeline specified in accepted offers. Failure to deliver may result in refunds, negative reviews, and account penalties.
4.4 Intellectual Property Compliance
Vendors are solely responsible for ensuring their products do not infringe on copyrights, trademarks, or other intellectual property rights. FanCraft Market is not liable for IP infringement by Vendors.
Note: "Fan-made" content must comply with applicable laws. We recommend creating transformative works and avoiding direct copies of copyrighted material.
5. Buyer Obligations
5.1 Payment
Buyers must pay for accepted offers in full. Disputes must be raised within 30 days of delivery.
5.2 Communication
Buyers must communicate clearly with Vendors and provide necessary information for custom orders.
5.3 Reviews
Reviews must be honest, relevant, and based on actual experiences. Fake or malicious reviews are prohibited.
6. Prohibited Activities
You may not:
- Circumvent the Platform to avoid fees
- List counterfeit, illegal, or prohibited items
- Harass, threaten, or abuse other users
- Scrape or data mine the Platform
- Manipulate reviews, ratings, or search rankings
- Impersonate others or provide false information
- Sell products that infringe intellectual property rights
- Use the Platform for money laundering or fraud
7. Intellectual Property
7.1 Platform Content
All Platform content (design, code, branding) is owned by FanCraft Market and protected by copyright and trademark laws.
7.2 User Content
You retain ownership of content you upload but grant us a worldwide, non-exclusive license to display, promote, and distribute it on the Platform.
7.3 DMCA Compliance
We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA). If you believe content infringes your rights, contact us at legal@fancraftmarket.com with:
- Description of the copyrighted work
- Location of the infringing content
- Your contact information
- A statement of good faith belief
- A statement under penalty of perjury
- Your physical or electronic signature
8. Disputes & Resolution
8.1 Between Users
Disputes between Vendors and buyers should be resolved directly. We may provide mediation but are not obligated to intervene.
8.2 Refunds & Chargebacks
Refund policies are set by individual Vendors. Unauthorized chargebacks may result in account suspension.
8.3 Arbitration
Any disputes with FanCraft Market must be resolved through binding arbitration, except where prohibited by law. You waive the right to class action lawsuits.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FANCRAFT MARKET IS NOT LIABLE FOR:
- Quality, safety, legality, or accuracy of Vendor products
- Vendor failure to deliver or buyer failure to pay
- Intellectual property infringement by users
- Indirect, incidental, or consequential damages
- Loss of profits, data, or business opportunities
Our total liability is limited to the fees you paid to us in the 12 months preceding the claim.
10. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE:
- Uninterrupted or error-free service
- Accuracy or reliability of content
- Security of data transmission
- Fitness for a particular purpose
11. Account Termination
We reserve the right to suspend or terminate accounts that violate these Terms, engage in prohibited activities, or harm the Platform community. Termination may result in forfeiture of pending funds.
12. Changes to Terms
We may update these Terms at any time. Changes will be posted with a new "Last Updated" date. Continued use of the Platform constitutes acceptance of revised Terms.
13. Governing Law
These Terms are governed by the laws of Ontario, Canada, without regard to conflict of law principles.
